UPDATE TO SUPER BOWL LIII ALCOHOL SALES HOURS FOR
SATURDAY, FEBRUARY 2!
To supplement our earlier post, unless the state legislature and governor adopt a new law this week, state law requires that alcoholic beverage sales cease at 2:55 AM on the night of Saturday, February 2/ morning of Sunday, February 3. The recently adopted City of Atlanta ordinance for the Super Bowl does NOT supersede state law.
Presently, we are unaware of any efforts in the state legislature to make a change to permitted hours of alcohol sales.

SUPER BOWL LIII WEEK
CITY OF ATLANTA ADOPTS EXTENDED ALCOHOL SALES HOURS
JANUARY 28, 2019 – FEBRUARY 4, 2019
Thanks to the Atlanta City Council, all businesses located in the city of Atlanta that are currently licensed to sell alcoholic beverages for on premises consumption and are in good standing, during the period of Monday, January 28, 2019 through Monday, February 4, 2019, are permitted to sell and serve alcoholic beverages from 9:00 AM until 4:00 AM each day except for Super Bowl Sunday, February 3. On Super Bowl Sunday, February 3, all on premises consumption licensees (regardless of percentage of alcoholic beverage sales, including bars and nightclubs) may sell and serve alcoholic beverages beginning at 12:30 PM and ending at 4:00 AM on Monday morning.
Additionally, thanks to the recent adoption of the “Brunch Bill,” on Super Bowl Sunday, businesses that derive at least fifty percent (50%) of their total annual gross sales from the sale of prepared meals or food, and all business establishments that derive at least fifty percent (50%) of their total annual gross income from the rental of rooms for overnight lodging, may commence alcoholic beverage sales and service at 11:00 AM on Sunday morning.
During the above period, all patrons of on premises consumption businesses must exit the alcohol licensed premises by 4:30 AM.

On Jan. 22, the Brookhaven City Council approved an amendment to the City of Brookhaven Code of Ordinances extending alcohol serving hours during Super Bowl week for current beer, wine or distilled spirits consumption on premises licensees. To be eligible for the extended hours, from Jan. 27 until 4 a.m. on Feb. 4, a business must:
- Have a current Brookhaven business license;
- Have a current alcohol consumption license;
- Be current on their excise taxes with the City; and
- Must follow the same security requirements in the existing alcohol ordinance.
Licensees meeting the above eligibility requirements may sell and serve alcoholic beverages during the following extended hours in the City of Brookhaven:
- Monday through Friday (Jan. 28-Feb. 1) sales of alcoholic beverages for on premises consumptions shall be from 11 a.m. until 4 a.m. the following day.
- Sales of beer, wine or distilled spirits for on premises consumption shall be permitted on Saturday, Feb. 2 from 11 a.m. until 2:55 a.m. on Sunday, Feb. 3.
- If a licensee is otherwise authorized to sell beer, wine or distilled spirits on Sundays pursuant to state law, the hours on Sunday, Jan. 27 and Sunday, Feb. 3, shall be from 11 a.m. on Sunday until 4 a.m. on Monday.
